Musoshi and affiliates (“Musoshi” or “we” or “us”) respect your privacy and are committed to protecting it. This Privacy Policy, together with all related agreements, information policies, documents including Musoshi’s Terms, describe how we handle the personal information we collect from you or that you may provide to us when you visit our websites such as musoshi.com (the “Site”), or which we gather in connection with services, products, and applications offered by Musoshi. Musoshi also maintains separate privacy notices addressing specific products and services (e.g., Musoshi insurance and Financing). In the event of a conflict between this Privacy Policy and these privacy policies, the latter more specific privacy policies govern with respect to their addressed subject matter.

We collect information about you, such as identifying information (e.g., name, driver’s license number), information about your vehicle (e.g., vehicle location, use, performance), payment data (e.g., payment type and method), and contact information (e.g., e-mail address, telephone number). Vehicle Location Data. Note that by agreeing to this Privacy Policy, you consent to the collection, use and sharing of your vehicle location data necessary for us to provide vehicle features and services. For example, our charging trip planning feature needs your vehicle’s location data to help locate the nearest charging station. Another example includes use of your vehicle’s location data to facilitate our Highway Assist feature. We may also use vehicle location data internally to the extent it helps us analyze, develop or improve our products and services. For example, location data can help us determine if certain environmental conditions where the vehicle traveled contributed to a vehicle system failure or necessitate the need for preventative maintenance. Information We Collect About You and How We Use It
The personal information we collect depends on how you interact with us, the products or services you purchase, and the choices you make. We collect personal information about you from different sources and in various ways including (i) through your commercial relationship with us such as when you provide it to us directly on the Site, via email, or through your online or offline/in-person interactions with us; (ii) from your vehicle either directly from an in-person visit (e.g., vehicle repair or service) or via vehicle telemetry or through your vehicle charger; or (iii) through automatic internet collection technologies. We may also collect your personal information from our contractors, service providers, employees, representatives of business customers, and other third parties including third party marketing companies that we use to provide you with information concerning our products, service offerings and other information. Information in connection with your charging activities

Consumption details, session data and charging records, such as information regarding your charging station and network consumption and usage, which includes type of charger you use, where it is located, charging kWh, time stamp for charging sessions, vehicle identification number (VIN), and duration of charging sessions. We also collect charging session data and records, such as speed of charge, session start, stop, unlatch, session cost, energy, idle times, charger ID, Musoshi ID, and other similar information. In addition, we collect payment type and method, and other payment or billing information if you provide it to us to facilitate your charging activities.

Information we collect from your vehicle. Note that the vehicle information set forth below may be linked to your vehicle identification number (VIN) or other identifier, and includes the following categories and examples:

Driver Behavior and Usage data, including vehicle location, vehicle direction (heading), speed, braking and acceleration events, driver profile preferences and recent destinations, Wi-Fi data including SSID and infotainment usage and preferences (including radio, in-vehicle apps, and phone pairing) and other vehicle feature usage including our Advanced Driver Assist System (ADAS), and vehicle telltale/indicator and signal usage. Note that we do not collect your mobile phone contacts and call history, and they are displayed in your vehicle only when your mobile phone is connected to the vehicle.

Operation and Performance data, including vehicle state (e.g., sleep, standby, ready, go/drive) battery usage and operational information, vehicle service history, charging statistics, odometer reading, electrical system functionality, hardware and software functionality information, infotainment system information, seat belt settings, diagnostic trouble codes, current charge state, and miles traveled, and sensor data, voice command information, external vehicle noise and vibration recordings, stability control or anti-lock events, security/theft alerts, driver and passenger presence in seat, vehicle dynamics and torque, sensor readings, thermal information, tire pressure, energy storage and efficiency, and other data to assist in identifying and analyzing your vehicle’s operation and performance.

Vehicle Service and Repair History data, including any recall information, details regarding services and repairs performed on your vehicle and other similar data.

Safety and Crash Details involving your Vehicle, including event data recorder data, air bag deployments, crash avoidance alerts, impact data, camera and video images and sensor data, safety system status, and other safety and crash related information concerning your vehicle. Note that we will not retrieve event data recorder data from your vehicle without your or your authorized representative’s permission or as permitted by applicable law.

Advanced Driver Assist System (ADAS) and Autonomy data, including sensor data, vehicle location and surrounding video images from our external vehicle cameras. These video images may incidentally capture pedestrians and license plate numbers, which we do not analyze specifically, process separately or associate with any identifiable individuals or vehicles. To promote safety, our Highway Assist feature utilizes a driver monitoring camera to alert the driver to stay attentive to the driving task while using this feature. We collect head and eye gaze directional data from that camera to determine whether a driver distraction alert should be initiated. We also collect metrics measuring the frequency of distraction alerts initiated by the system.

Roadside Service, and SOS Services data, including vehicle location, time of crash, crash details indicating severity of crash and where impact occurred. This data is collected and shared when a crash occurs triggering an airbag deployment or a rear impact collision meeting our severity threshold for notification. We also collect information regarding SOS calls made from your Musoshi vehicle or under your Musoshi account such as the time, date and duration of your call. We may also record your call for quality control purposes. We may also collect your vehicle identification number (VIN), location, reason for service or emergency call, where the vehicle is being transported for service or storage and other related information.

How we use it

How we use interactions and commercial relationship information

To provide our products and services and further our commercial relationship. For example, we use your information to facilitate and configure Musoshi vehicle pre-orders, facilitate your title and registration and delivery, communicate updates concerning your vehicle, provide our Musoshi services, or contact you as necessary to fulfill orders or reservations you have placed for Musoshi products, services, demonstration drives, or home installation. We may also contact you to ask for your feedback about a product, service, or event. We may also use your information to facilitate vehicle purchasing, financing or a vehicle trade-in. We may further use your information to assist you in connection with our services including roadside, SOS/eCall and emergency services or to configure your remote vehicle key fob.

To send you promotional material, further marketing activities and fulfill your requests. Promotional or marketing materials may include newsletters or other information regarding Musoshi contests, events, and/or products or services. We also use your information to market or share other Musoshi services or products that may be of interest to you based upon information you have provided to us. How we use vehicle information. We may use your vehicle information for the following purposes:

To provide vehicle features and services, including vehicle information necessary (e.g., vehicle location) to provide our charging trip planning feature, visualize trip summaries, Roadside and SOS/eCall services, and ADAS/autonomy features (including our Highway Assist feature and its driver monitoring camera).

To provide vehicle repair, safety, warranty, collision, and maintenance support and services. We may also use your information to assist with safety recalls or other initiatives aimed at improving vehicle safety or functionality. In connection with these services, we may also use your vehicle identification number or Musoshi ID or other identifier to contact you with service bulletins or safety information, or to deliver an over-the-air software update to your vehicle.

To analyze and use for legitimate business purposes such as vehicle trade-ins, fraud detection, vehicle crash analysis, and tampering.

To enable ongoing vehicle reliability improvements and to develop and improve vehicle diagnostic, repair and maintenance strategies. This includes servicing your vehicle as well as analyzing remotely your vehicle’s operation, performance and use, which may involve the aggregation of your vehicle data with other Musoshi vehicles to predict and troubleshoot potential vehicle failures or understand causes leading to a vehicle failure.

Information Collected through Automatic Data Collection Technologies, as you navigate through and interact with the Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, which includes the items set forth below. We use this information to personalize your experience on the Site or with the company and/or to improve the security, design, and/or function of the Site. We do not use this information for behavioral advertising or share this information for behavioral advertising.

Information Automatically Collected via the Site. When you visit the Site, Musoshi automatically collects certain technical information from your browser, such as the internet protocol (IP) address used to connect your computer to the internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, and other data about your visit to the Site.

Information Collected Using Cookies. Cookies are data files created when you visit a website and those files are stored locally (on your device). When visiting the Site, we may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to make your experience on the Site more personal and interactive. Information collected may include websites you visited before browsing the Site, pages you viewed on the Site, number of times you accessed the Site, how long you spent on the Site, and other web traffic data. You may be able to disable the use of Cookies (or disallow the use of Cookies on specific websites) by adjusting your web browser settings.

Information Collected Using Other Tracking Tools. In addition to, or in conjunction with Cookies, we may use other tracking tools to improve users’ experiences on the Site. Your responsibilities

Privacy Choices for Vehicle Data Collection. Your privacy choices including how we collect data from your Musoshi vehicle attach to your Musoshi account and driver profile. Because of this, we rely on you to inform anyone else driving your Musoshi vehicle regarding this Privacy Policy and your privacy choices.

Third-Party Vehicle Apps. We recommend you review the terms and conditions, privacy policies and settings for any third-party app or service (e.g., Spotify, Alexa) to which you subscribe to and/or use in your Musoshi vehicle or product. A third-party may ask you to grant certain permissions, for example, information about your vehicle’s location. We are not responsible for apps or services provided by any third party, which includes their use of your data.

Gear Guard™️ Cameras. You may capture external video images through our Gear Guard video and perimeter features. You control the collection and use of this data, and we do not access it without your consent.
Our Sharing of Your Personal Information
We share personal information with our affiliates and as set forth below for legitimate business purposes, which also includes when you direct us to share it with others, or as necessary to complete your transactions or provide the products or services you have requested or authorized.
We share your personal information with the following parties:

Technology and Other Service Providers. With software, IT, customer relationship management, wireless, mapping, data analytics, cybersecurity, charging, cloud service, consultants, financial, legal and other similar providers we use to support our business.

Business Partners and Other Third Parties. With parties where you have elected to receive a service from them, authorized them to receive data from Musoshi, or directed us to share your personal information with them. For example, you may direct us to share certain vehicle information with a vehicle usage-based insurance provider for your insurance purposes, or to share your personal information with an electric utility or charging installer in connection with your Musoshi product or service. We may also share your information with repair and collision shops and insurance companies to allow us or a third party to service, maintain and repair your vehicle. We additionally may share your personal information with any other third parties that you authorize.

Emergency Service and Roadside Providers. With our third-party connected vehicle software provider and emergency service providers, third-party call center(s), roadside assistance providers (e.g., tow truck operator), law enforcement and EMS personnel in connection with our roadside and SOS/eCall service offerings.

Third Party Advertising. With our marketing service providers with your consent where required.

With Other Third Parties Including Law Enforcement. We may share your personal information when legally required or when we deem advisable to do so, such as at the request of governmental authorities or law enforcement or to verify or enforce compliance with policies governing the Site and applicable laws. In addition, we may disclose your personal information if we believe disclosure is necessary or appropriate to protect the rights, property or safety of others or Musoshi. Musoshi may also participate in state and federal government programs aimed at reducing carbon emissions. Some programs may require sharing vehicle data and charging information, which could include your vehicle identification number and where your vehicle was charged. We may also share your personal information with other third parties if you authorize us to do so.

Corporate Transactions. In connection with, during, or upon completion of a merger, acquisition, asset sale, or other business transaction that involves some, or all, of Musoshi’s assets, data you have provided to Musoshi may be transferred to a third party such as a successor or purchaser as part of a transaction.
We may share de-identified information in accordance with applicable law without restriction with third parties for legitimate business purposes.
Data Security
We use reasonable administrative, technical and physical security to protect the personal information we retain and to help ensure that it is used in accordance with this Privacy Policy. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless longer retention is required by law or for auditing purposes.
